The FTBC Terms and Conditions

These are the terms and conditions of THE FTBC Limited (Company Number 07270716) whose registered office is at THE FTBC Limited, 28 WHITTLES CROFT, MANCHESTER, LANCS, M1 2DE, ENGLAND.

THE CLIENT'S STATUTORY RIGHTS AS A CONSUMER ARE NOT AFFECTED BY ANY OF THE PROVISIONS OF THESE TERMS AND CONDITIONS

1. THE FTBC LIMITED ("The First Time Buyer Club") offers the following services (together the "Services") to those who have registered on the THE FTBC website ("Clients"):-

    1.1 Information contained within the website is for general information only.

    1.2 Whilst every care is made to ensure that information held within the site is up to date and correct, THE FTBC will not be held responsible for any out of date or incorrect information.

    1.3 THE FTBC does not accept any responsibility for any business carried out by or communications from its advertisers, affiliates and 'partners' or mortgage advisors whose services may be featured or promoted on the site.

    1.4 THE FTBC may at its sole discretion refuse to accept an application for registration.

    1.5 THE FTBC does not offer personal financial advice. By using or registering on the site, all site visitors agree that they accept this. Where specialist advice is sought it should be from specialist suppliers.

    1.6 These terms and conditions of business shall govern all contracts entered into for the supply by THE FTBC of the Services to the Client. By registering with THE FTBC the Client acknowledges that he/she has read and accepts these terms and conditions.

    1.7 Notwithstanding anything else contained in these terms and conditions THE FTBC shall not be liable to the Client for loss of profits or contracts or other indirect or consequential losses whether arising from negligence, breach of contract or otherwise.

    1.8 Given the nature of the Services it is not THE FTBC's usual policy to give refunds. However, client satisfaction is very important to THE FTBC and requests for refunds will be reviewed very carefully on a case by case basis. THE FTBC may at its discretion offer a refund as a gesture of goodwill in appropriate cases.

    1.9 THE FTBC accepts no liabilities for any actions taken as a result of visiting its websites or for the contents therein.

    1.10 THE FTBC earns  a small commission by refering sales to it's network of associated mortgage advisors.

2. Data protection

    2.1 THE FTBC is registered in accordance with the Data Protection Act 1998 (the "Act ") and shall process any personal data supplied by the Client in strict accordance with the Act.

    2.2 THE FTBC may provide the Client's details to relevant third parties in order to provide the Client with information about other goods and services which may be of interest.  A registration application cannot proceed unless the Client by ticking the box contained in the on-line application gives such consent.

    2.3 Without prejudice to the generality of the Client's consent, the Client by ticking the box contained in the on-line application to confirm he/she has read and agrees to these terms and conditions shall be deemed to consent to THE FTBC providing his/her personal data to associated companies who may contact the Client with a view to providing mortgage, financial, property or legal advice or publicising THE FTBCs services. Any remuneration associated with such mortgage and/or financial/legal advice will be agreed between the Client and that associated company as a separate arrangement outside of these terms and conditions and any registration fees charged by THE FTBC. Although THE FTBC maintains this introductory arrangement, THE FTBC does not take any responsibility or liability for the accuracy, adequacy and completeness of the mortgage, financial or legal advice given by any of the associated companies.

    2.4 Upon cancellation of the Client's registration for whatever reason THE FTBC shall maintain the Client's data for a reasonable period for administrative purposes and the purposes set out in these terms and conditions, after which it will be deleted.

    2.5 THE FTBC or media companies may contact Clients to ask for assistance with publicising the Services. The Client has the right to decline offering their assistance for this purpose.

3. General

    3.1 THE FTBC shall not be responsible for any delays in performing, or for failure to perform, any of its obligations hereunder if the delay or failure was due to any cause beyond THE FTBC's reasonable control.

    3.2 If any provision of these terms and conditions is declared by any judicial or any other competent authority to be void, voidable, illegal or otherwise unenforceable or indications to that effect are received by either party from any competent authority then that provision shall be limited or eliminated to the minimum extent necessary so these terms and conditions shall otherwise remain in full force and effect and enforceable.

    3.3 These terms and conditions supersede any prior agreement (oral or in writing) between THE FTBC and the Client and contain the whole agreement between them. The Client acknowledges that he/she has not relied upon any oral or written representations made by THE FTBC or its employees or agents.

    3.4 These terms and conditions shall be governed by English Law and the parties shall submit any dispute arising hereunder to the non-exclusive jurisdiction of the English Courts except as mentioned in paragraph 7.5 below.

    3.5 Where the Client is resident in Scotland and the contract between the parties relates to property in Scotland these terms and conditions shall be governed by Scots Law and the parties shall submit any dispute arising hereunder to the non-exclusive jurisdiction of the Scottish Courts.

    3.6 Any references to mortgages made on the THE FTBC websites are made for purely generic information only purposes and any reference made is not a statement of financial advice or any indication of suitability for any of THE FTBC's clients individual circumstances. THE FTBC is not authorised by the Financial Services Authority under the Financial Services Act or Council of Mortgage Lenders under the Mortgage Code or any other regulated body and is therefore unable to give any kind of advice in these areas. Clients are strongly encouraged to seek financial and/or mortgage advice before entering into any mortgage or other financial arrangement.

    THE FTBC does offer a useful links page from its own websites to those of relevant third parties. Any such link is not a statement of recommendation of any of the services promoted on the said linked websites or due to any other links on the THE FTBC site. The directors of THE FTBC do not take any responsibility or liability for the accuracy, adequacy and completeness of the information which is not directly on the THE FTBC Web-site and set out in the terms listed above.

    3.7 In respect of the Mortgage Scenarios these are for factual information only and do not convey any type of financial advice.
